These Terms of Service (“Terms”, “Terms of Use”) govern your use of the Power Commerce, Inc. website and services (“Service”), including any apps, themes, or other products operated by Power Commerce (“we”, “us”, “our”). By accessing or using the Service, you agree to comply with these Terms. If you disagree with any part of these Terms, you may not use the Service.

Eligibility

To use the Service, you must:

• Be at least 18 years old and legally capable of entering into contracts.

• Agree to these Terms.

• Provide accurate, complete, and current contact information.

• Not be subject to any EU, US, or UN sanctions, embargoes, or restrictions prohibiting the use of this Service.

By using the Service, you represent that you meet these requirements and agree not to violate any laws. Power Commerce reserves the right to refuse service, close accounts, or change eligibility requirements at any time.

Subscriptions

Certain parts of the Service may require a subscription (“Plan(s)”). Subscriptions are billed in advance on a recurring monthly basis or as specified by the plan you choose. A minimum number of billing cycles may apply.

Subscriptions will automatically renew at the end of each cycle unless you cancel or Power Commerce cancels it. To cancel, you can either update your account settings or contact customer support, with at least a 30-day notice.

A valid payment method, such as credit cards, Shoppay, GooglePay, or ApplePay, is required. By providing payment details, you authorize Power Commerce to charge you for all Subscription fees incurred through your account.

Free Plan

Power Commerce may offer a free subscription plan at its discretion. This plan is subject to change or cancellation at any time, without notice.

Fee Changes

Power Commerce may adjust Subscription fees at any time. Any changes will take effect at the end of the current billing cycle. We will provide reasonable notice of any fee changes so you can decide whether to continue or cancel your subscription.

If you continue to use the Service after the fee changes, you agree to the new rates.

Authorized Use of the Service

You may only use the Service for lawful purposes that align with its intended purpose. You must not use it to solicit discriminatory or offensive information or engage in illegal activities.

5.1 Limited Liability Clause:
Power Commerce disapproves of unauthorized use of copyrighted material on eCommerce websites. While you have control over the content you upload, Power Commerce is not responsible for any damages resulting from the unauthorized use of copyrighted content. If we are notified of such violations, we will take appropriate action in line with applicable laws.

Accounts

When signing up for any Power Commerce services, you must provide accurate and up-to-date information. Failure to do so may result in account termination. You are responsible for securing your account password and any activities that occur under your account.

If you become aware of any security breaches or unauthorized use, you must notify us immediately.

Intellectual Property

The content, features, and functionality of the Service are owned by Power Commerce and its licensors and are protected by copyright laws. You may not use our trademarks or intellectual property without permission.

You also agree that Power Commerce owns the rights to aggregated test scores, which may be used to improve our Services.

Links to Third-Party Websites

Our Service may contain links to third-party sites or services we do not control. We are not responsible for the content, privacy policies, or practices of these external sites. Please review their terms and policies before interacting with them.

Data Protection

We collect, store, and use information about you in accordance with our Privacy Policy.

Termination

We may suspend or terminate your account at any time without notice, especially if you breach these Terms. If you wish to stop using the Service, simply discontinue use and inform us.

Limitation of Liability

In no event will Power Commerce or its affiliates be liable for indirect, incidental, special, or consequential damages, including loss of profits or data, arising from your use or inability to use the Service, third-party conduct on the Service, or unauthorized access to your content.

Disclaimer

The Service is provided “as-is” and “as-available.” We do not guarantee that the Service will be uninterrupted, secure, or free from errors. Power Commerce makes no warranties regarding the Service’s functionality or reliability.

Changes to Terms

We reserve the right to modify or replace these Terms at any time. By continuing to use the Service after changes take effect, you agree to the updated Terms. If you disagree with any changes, please stop using the Service.

Partial Invalidity

If any part of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in effect.
